"Georgia Power Yellow Dirt Cemetery" UP-DATE

We had City, county and highway patrol cars one after another circled the block the whole time we were there. One, I think the chief of police?? sat in the window of Georgia Power watching us.

Mr. Mark Williams, "Georgia Power" was present in defense of Georgia Power Plant Wansley's actions concerning Yellow Dirt Baptist Cemetery.

In all fairness, Mark, was cordial but. He claimed Georgia Power Plant Wansley did the right thing by the Web brothers and that's all they would do. When I ask if an apologia was forth coming, he said no. I ask him as a man could he apologize to me, a Veteran, for the inaction of Georgia Power not doing the right thing.... His answer was no.

We could care less about the Web & Georgia Power property issue.... It's the law being enforced we now want as it appears they do not want to reason.

The time for protesting Georgia Power should now be over. Southern Legal Resource Center, The SCV and all our many heritage groups need to pursue legal action it this matter.

The bottom line is that the graves of American Veterans are sacred hallowed ground made such by their service to their country, and the placing of the flags are memorials to that service and honoring of their bravery and sacrifice for the rest of us. Both the graves, and the flags thereon are fully protected by full faith and force of law.

It's the law. We must pressure the legal system State and Federal to see the law is enforced!

Ain't we and our Southern heroes & flag been kicked around enough?!!

Confederate Veterans ARE United States Veterans under the eyes of US LAW:

U.S. Public Law 85-425: Sec. 410 Approved 23 May 1958
(US Statutes at Large Volume 72, Part 1, Page 133-134)
The Administrator shall pay to each person who served in the military or naval forces of the Confederate States of America during the Civil War a monthly pension in the same amounts and subject to the same conditions as would have been applicable to such person under the laws in effect on December 31, 1957, if his service in such forces had been service in the military or naval forces of the United States
U.S. Code Title 38 – Veterans’ Benefits, Part II – General Benefits, Chapter 15 – Pension for Non-Service-Connected Disability or Death or for Service, Subchapter I – General, § 1501. Definitions: (3) The term “Civil War veteran” includes a person who served in the military or naval forces of the Confederate States of America during the Civil War, and the term “active military or naval service” includes active service in those forces
Confederate Flags ARE protected under Georgia Law:
GEORGIA CODE 50-3-1(4) It shall be unlawful for any person, firm, corporation, or other entity acting without authority to mutilate, deface, defile, abuse contemptuously, relocate, remove, conceal, or obscure any privately owned monument, plaque, marker, or memorial which is dedicated to, honors, or recounts the military service of any past or present military personnel of this state, the United States of America or the several states thereof, or the Confederate States of America or the several states thereof. Any person or entity who suffers injury or damages as a result of a violation of this paragraph may bring an action individually or in a representative capacity against the person or persons committing such violations to seek injunctive relief and to recover general and exemplary damages sustained as a result of such person or persons unlawful actions.
50-3-9. It shall be unlawful for any person, firm, or corporation to mutilate, deface, defile, or abuse contemptuously the flag of the United States, the flag, coat of arms, or emblem of the State of Georgia, or the flag or emblem of the Confederate States of America by any act whatever.
50-3-10. Nothing in this article shall be construed to prevent the use of the flag of the United States or any flag, standard, color, shield, ensign, or other insignia of the State of Georgia or of the Confederate States of America for decorative or patriotic purposes, either inside or outside of any residence, store, place of business, public building, or school building.
50-3-11. Any person, firm, or corporation who violates any provision of Code Section 50-3-8 or 50-3-9 shall be guilty of a misdemeanor.
Confederate Veteran Graves ARE protected under Georgia Law:
GEORGIA CODE O.C.G.A. 16-7-26 (2010)
16-7-26. Vandalism to a place of worship
(a) A person commits the offense of vandalism to a place of worship when he maliciously defaces or desecrates a church, synagogue, or other place of public religious worship.
(b) A person convicted of the offense of vandalism to a place of worship shall be punished by imprisonment for not less than one nor more than five years.

16-8-2. Theft by taking
A person commits the offense of theft by taking when he unlawfully takes or, being in lawful possession thereof, unlawfully appropriates any property of another with the intention of depriving him of the property, regardless of the manner in which the property is taken or appropriated.

16-7-21. Criminal trespass
(3) (e) A person commits the offense of criminal trespass when he or she intentionally defaces, mutilates, or defiles any grave marker, monument, or memorial to one or more deceased persons who served in the military service of this state, the United States of America or any of the states thereof, or the Confederate States of America or any of the states thereof, or a monument, plaque, marker, or memorial which is dedicated to, honors, or recounts the military service of any past or present military personnel of this state, the United States of America or any of the states thereof, or the Confederate States of America or any of the states thereof if such grave marker, monument, memorial, plaque, or marker is privately owned or located on land which is privately owned.

Heard Co. Commission Chairman admits knowing the guilty was a male. Veterans Day came and went without a single apology, any restitution, and no arrests. Once upon a time Sheriff Henry told the Sons of Confederate Veterans he supported us, and if there was anything we ever needed, just call. Sheriff, we know your phone has been ringing quite a bit.....

The latest development in the Yellow Dirt Baptist Cemetery saga that began in early October 2011 when a member of the Webb family, whose ancestor, Confederate veteran J. P. Shelnutt, is buried there, reported that Confederate flags placed the graves of Shelnutt and other Confederate veterans had been removed, is an admission by Georgia Power Company spokesperson Mark Williams that Georgia Power does not, as it had believed, own the cemetery.

According to Williams, "After completing a title search and survey, we concluded that there are portions of the property in question that are owned by the Webbs. We will continue to control access to the site, since it is within plant grounds." (In order to build Plant Wansley, property completely surrounding the cemetery was purchased decades ago by Georgia Power.) Previously Georgia Power had justified the removal of the flags on the basis of them being offensive to some of its employees.

After learning that the flags had been removed, members of the Haralson Invincibles, Sons Of Confederate Veteran's Camp #673, replaced the flags. Subsequently these flags were removed and replaced. According to a report in the "Heard County Citizen" after the Invincibles' initial replacement of the flags, Georgia Power spokesperson Konswello Monroe said "Yes, we did remove those flags that were put up October 8, and we will be monitoring. If they are put back up we will remove them once again."

Sons of Confederate Veterans member and historical researcher Earnest Everett Blevins of Villa Rica says that Georgia Power "only recognizes part of the Webbs' issues but none of the other issues raised. They do not apologize, especially after beating their chest quite loudly about how they believe they own and they will control it and what goes on in it. They do not report the names of those responsible for the theft of the first flags, never returned nor paid restitution for, nor the second flags. They do not acknowledge that, despite the fact they have a legal department, they did not know it was illegal to remove grave goods."

Blevins believes that it is “unlikely a quiet admission is going to satisfy all the parties now involved,” all of whom are "citizens of Georgia who wish to see laws on the books enforced. If these laws are not enforced, this type of activity will continue unpunished, if not here, then elsewhere. This is a clear case of violating the laws, which are widely published in the local media, on line, and legal libraries."

At its October 25, 2011 meeting, the Heard County Board of Commissioners discussed the theft of the flags. (The majority of the Plant Wansley property is in Heard County.) Blevins believes that the Heard County sheriff's office "must pursue" this case. However, he says that "the Sheriff's office seems to not want to investigate until some names are given although I and others think that is their job. After all, if someone broke into your house and stole your flags, would they investigate only after you gave them names?"

Another Southern Flag bites the Dust!

Confederate flag removed from Caddo Courthouse overnight.

The Flag is Gone!!


The Confederate flag will no longer fly in front of the Caddo Parish Courthouse after the Caddo Commission voted 11-1 Thursday take down the flag and flagpole that flies it.







District 5 Commissioner Joyce Bowman requested the removal.
"I feel great. The parish of Caddo and the city of Shreveport should feel great also," she said. "It's been a long time coming, and it's time for us to move on."
